Simple Process of Debt Recovery if no response from debtor
Step 1 Letter of Demand: send a formal letter of demand to the email and or residential address of the debtor. Allow between 7 to 14 days for the other party to respond or repay.Step 2 Notice to Sue: send a formal Notice to sue, this will act as a final notice before you commence legal proceedings. Give the other party 7 to 14 daysStep 3 Statement of Claim: the first Legal step for you to take is to file a statement of claim. We strongly recommend getting legal input during this step.Step 4 Default Judgment: If no response or defence is received you may then file for default judgment.Step 5 Enforcement: enforce the judgement by issuing an examination/garnishee/writ for the levy of property on the debtor.
