澳洲购买楼花小贴士

房屋预售许可证俗称楼花。楼花又叫期房,是地产物业市场的名词,是一种投资工具不动产期货,指预售的尚未完成的地产发展项目。不同于现房买卖,买家未见实物即签订合同,交易风险自然相对较大。但大家也不必过度担心,因为澳洲几乎所有的新公寓都是以这种方式出售的,楼花买卖是一种非常常见的购房方式。 基本步骤: 表达购房意愿并支付定金若决定购买某套楼花,您需要签署一份意向书(expression of interest)。此文件包含您购买楼花所需的基本个人信息,律师需要这些信息准备楼花买卖合同。签署完之后您需要缴纳一笔初始定金,这表明您承诺买入相关楼花,开发商有责任准备楼花买卖合同并发给您的律师进行审查。审查合同需要非常谨慎,确保合同内容都是您认可的,若有偏差,可要求进行相应的更改。合同 楼花买卖合同比普通REIQ房屋买卖合同复杂得多。一般来说,开发商的律师会提供合同,由您自己的律师进行审查,没有异议才可签字。大多数情况下,有经验的律师会在三四天之内代表您仔细审查合同并给您提供详细的意见和建议。支付定金 所有购买楼花的人都需要缴纳定金,金额一般占房屋总价的百分之十。您通常有两个选择: 1. 现金、转账或支票:定金会存放在卖方律师事务所的信托账户,因为依据澳洲法律,购买房屋的建筑期内,任何金额的款项均不可汇入开发商的账户,这样一来,极大程度地保护了买方的利益。2.银行保函 (Bank Guarantee)您可选择澳洲任何一家银行,开一张保函,把百分之十的定金存入即可。实质上,这笔钱并未支付,只是作为保证金冻结在银行。这是一笔定期存款,在固定时期内不可动用,存款产生的利息您可以全部拿走。当然,银行会收取一些手续费,您可具体咨询不同银行,货比三家,挑一家收益最高最适合的。日落条款 按照惯例,楼花买卖合同包含3.5年的日落条款。该条款是为维护买方利益而设,它要求卖方在签订合同后的3年半内完成该项目。这也是为该项目提供资金的银行的要求。如果该项目在三年半内未完成,买方有权终止合同或和开发商签订延期合同。交割
