离婚后,孩子抚养权一定归母亲吗?

离婚并不是一个轻松的决定,特别是夫妻双方有了孩子以后。孩子的利益仍是大多数离异父母首先考虑的问题。在过去,大多数儿童抚养案都偏向母亲,父亲只能在周末见到孩子。主要是因为过时的传统观念认为父亲需要在外赚钱养家而母亲则是在家带娃的角色。如今,面对抚养权纠纷,法院更愿意侧重于共同的监护权,从而确定哪一位父母最适合承担抚养孩子的主要义务。不论是母亲还是父亲,决定抚养权分配唯一的原则就是孩子的最大利益。此原则的法律基础是2006年修订的法案。但不可否认的是,大多数案件母亲都能拿到孩子的主要抚养权。
关于Family Law Amendment(Shared Parental Responsibility)Act 2006:首先,在澳大利亚家庭法中,母亲不享有绝对权力,当然父亲也一样。其次,此法案的主要思想是促进与推动父母的共同责任。另外,非常重要的一点是父母的责任与抚养权不同。父母任一方获得抚养权并不代表其能为孩子做出所有重大及长期的决定。这些重大决定包括孩子上学地点,手术医疗等等。基于共同责任,父母需要共同做出决定。如果孩子的母亲做出重大决定而父亲反对,即使母亲拥有主要抚养权,父亲也有权阻止母亲做出此项决定。
关于孩子的最大利益,有两个信条:首先,孩子有权利从父母关系中受益。其次,孩子有权受到保护,免受身体、心里、情感以及性伤害。如果父母婚姻关系意味着孩子受到虐待(包括有被虐待风险),父母会被禁止接触孩子。澳大利亚婚姻法认为孩子有知情权以及被父母双方照顾的权利,因而澳洲法律遵循父母对子女享有平等抚养责任的推定。所以,妈妈是否享有抚养权归根结底取决于是否能实现孩子的最大利益。
